1. Definitions
For purposes of these Terms: “Gigways,” “we,” “our,” or “us” refers to Gigways LLC. “You” or “User” means any person or entity who accesses or uses the Services. “Services” means the Gigways mobile application, website, and any related tools, content, features, and services we make available, including features available prior to login. “User Content” means any content you submit, post, upload, or otherwise make available through the Services (including posts, comments, likes, images, reports, or other materials).
2. Acceptance; Binding Agreement
These Terms constitute a legally binding agreement between you and Gigways. By clicking “Accept,” “I Agree,” “Agree,” “Continue,” “Get Started,” “Sign Up,” or “Log In,” or by otherwise accessing, installing, registering for, previewing, or using the Services (including any features available before login), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not access or use the Services.
3. Eligibility; Age Requirements
You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Services. If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the Services and that your parent or guardian agrees to these Terms on your behalf.
You may not use the Services where prohibited by applicable law, and you represent and warrant that your use of the Services complies with all laws, rules, and regulations applicable to you.
4. Scope of Services; No Professional Advice
The Services are intended to provide organizational tools and optional community and coordination features tailored to the gig economy. The Services may present information, reminders, summaries, or calculations based on data you enter or permissions you enable. The Services do not provide legal, tax, financial, insurance, medical, or professional advice. You are solely responsible for verifying any information and for consulting qualified professionals regarding your specific circumstances.
Gigways does not guarantee earnings, work availability, business outcomes, tax treatment, deductions, or compliance readiness.
5. Accounts; Security; User Responsibilities
Certain portions of the Services may require you to create an account. You agree to provide accurate information, keep it up to date, and maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
- Security incidents: You must notify us promptly if you suspect unauthorized access or a security incident.
- Your equipment: You are responsible for your device, operating system, data plan, and network access required to use the Services.
- Data accuracy: You are responsible for the completeness and correctness of data you input or upload.
6. Licenses; App Use; Restrictions
Subject to your compliance with these Terms, Gigways grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, lawful purposes. You agree not to copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Services except as permitted by law.
We reserve all rights not expressly granted to you.
7. Community Features; User Content; Moderation
The Services may include optional “Community Features” (such as posts, likes, comments, and reporting tools). Community Features are voluntary and may be disabled, limited, or removed at our discretion.
7.1 User Content License
You retain ownership of your User Content. However, by submitting User Content, you grant Gigways a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your User Content solely for the purpose of operating, improving, securing, and enforcing the Services and these Terms.
7.2 Moderation and Enforcement
We may, but are not obligated to, monitor, review, remove, or restrict User Content and accounts. We may take enforcement actions, including warnings, content removal, feature restrictions, or suspension/termination where we believe it is necessary to protect users, prevent fraud, comply with law, or enforce these Terms.
8. Safety; Driving; Device Use
You agree to use the Services responsibly and safely. Do not use the Services in a manner that distracts you while driving, operating a vehicle, or performing any activity requiring attention. You are solely responsible for complying with traffic laws, safety rules, and any platform policies applicable to your gig work.
9. Private Trips: Coordination Only; No Transportation/Delivery Services
“Private Trips” is an optional coordination feature intended to help users coordinate friends rides, food pickup, and parcel drop with individuals they personally know and trust (typically via mutually added contacts). Private Trips is not an on-demand public gig platform and is not intended to connect strangers.
9.1 No Transportation, Delivery, Logistics, or Dispatch Services
Gigways is not a Transportation Network Company (TNC), ride-hailing service, taxi, courier, dispatcher, commercial transportation provider, food delivery provider, or logistics platform. Gigways does not operate vehicles, does not screen or supervise users, and does not direct or control any activity arranged through Private Trips.
9.2 Payments Outside of Gigways
Any contribution, reimbursement, or payment between users is optional and occurs outside of Gigways. Gigways does not process, track, or manage payments for Private Trips.
9.3 Assumption of Risk
Private Trips are private arrangements between users. You assume all risks associated with rides, food pickup, parcel drop, and any interactions with other users, including risks of accidents, injury, theft, disputes, or misconduct.
10. Gig Board (User-to-User Platform) – Legal Disclaimer & Liability Protection
The Gig Board is an optional feature within Gigways that allows users to independently post, browse, accept, respond to, chat about, and communicate regarding gig opportunities. The Gig Board operates strictly as a user-to-user posting and communication platform. Gigways provides technology tools only and is not a party to any gig, agreement, communication, payment, transaction, service, job, task, or arrangement between users.
10.1 Platform Role Only
Gigways is not an employer, hiring company, staffing agency, contractor, subcontractor, broker, agent, payment processor, escrow provider, insurer, guarantor, background-check provider, or dispute-resolution service. Gigways does not hire, employ, supervise, control, direct, train, manage, assign, schedule, dispatch, or compensate any user in connection with the Gig Board.
- Gigways does not create or enter into gig agreements on behalf of users.
- Gigways does not set, control, or enforce gig prices, terms, conditions, deadlines, quality standards, or payment timing.
- Gigways does not guarantee that any posted gig is legitimate, available, lawful, safe, accurate, or completed.
- Gigways does not guarantee that any user is qualified, reliable, honest, licensed, insured, or legally permitted to perform a gig.
10.2 No Payment Processing, No Payment Guarantee, and No Escrow
Gigways does not process, collect, hold, transfer, escrow, guarantee, reimburse, refund, or facilitate payments for Gig Board gigs. Any payment, reimbursement, tip, deposit, fee, compensation, or other financial arrangement is made directly between users outside of Gigways and entirely at the users’ own risk.
- Gigways is not responsible for unpaid gigs, late payments, partial payments, chargebacks, refunds, canceled payments, or payment disputes.
- Gigways does not enforce private payment agreements between users.
- Gigways does not verify whether a user has funds available or intends to pay.
- Users are solely responsible for deciding whether to request advance payment, written confirmation, proof of payment, receipts, or other protections.
10.3 No Guarantee of Work, Quality, Completion, Safety, or Outcome
Gigways does not guarantee any gig, user, task, result, payment, safety condition, quality of work, timeliness, legality, communication, or outcome. Users understand and agree that all Gig Board interactions are voluntary and occur solely between the participating users.
- Gigways is not responsible if a user fails to appear, cancels, refuses to pay, performs poor work, damages property, acts dishonestly, or violates an agreement.
- Gigways is not responsible if a gig poster provides inaccurate information, changes the work scope, refuses access, cancels the gig, or fails to communicate.
- Gigways is not responsible for scams, fraud, misrepresentation, harassment, threats, unsafe conditions, illegal conduct, or user misconduct.
10.4 User Responsibility and Assumption of Risk
By using the Gig Board, each user acknowledges and agrees that they are solely responsible for their own decisions, communications, meetings, agreements, work, payments, safety, legal compliance, taxes, licenses, permits, insurance, tools, equipment, transportation, and conduct. Users should independently verify other users, gig details, payment arrangements, legal requirements, location safety, and any other relevant facts before posting, accepting, starting, or completing a gig.
Users assume all risks arising from or related to the Gig Board, including risks of non-payment, incomplete work, poor workmanship, cancellation, fraud, personal injury, property damage, theft, loss, harassment, discrimination, unsafe conditions, and disputes.
10.5 User Communications and Contact Information
The Gig Board may allow users to chat, respond to postings, exchange contact information, or communicate directly. Users are solely responsible for what they choose to share and for any consequences of sharing personal information, phone numbers, addresses, payment information, schedules, photos, documents, or other details. Gigways does not guarantee the confidentiality, accuracy, reliability, or safety of communications between users.
10.6 User-Generated Listings and Content
Gig Board listings, descriptions, pay amounts, locations, dates, requirements, photos, and messages are user-generated content. Gigways may review, remove, restrict, or moderate content in its discretion, but Gigways has no obligation to verify, screen, monitor, edit, approve, or police every listing or communication.
- Users may not post false, misleading, illegal, unsafe, discriminatory, abusive, exploitative, or fraudulent gigs.
- Users may not post gigs involving illegal goods, illegal services, weapons, controlled substances, sexual services, exploitation, harassment, violence, or activity prohibited by law or these Terms.
- Gigways may remove listings, restrict features, or suspend accounts at any time when we believe there is safety risk, legal risk, fraud, abuse, or a Terms violation.
10.7 Disputes Are Strictly Between Users
All disputes, claims, demands, or disagreements arising from Gig Board activity are strictly between the users involved. This includes disputes regarding non-payment, underpayment, incomplete work, poor quality, canceled gigs, property damage, injuries, misconduct, fraud, scams, misrepresentation, scheduling, scope of work, taxes, insurance, or any other issue.
Gigways is not required to mediate, investigate, resolve, pay, refund, compensate, enforce, or participate in user disputes. Gigways may, in its discretion, review reports and take platform enforcement actions, but such actions do not make Gigways responsible for the underlying dispute or outcome.
10.8 No Employment, Agency, Partnership, Joint Venture, or Contractor Relationship
Use of the Gig Board does not create any employment, independent contractor, agency, partnership, franchise, joint venture, fiduciary, representative, or similar relationship between Gigways and any user. Users are not employees, contractors, agents, representatives, partners, or workers of Gigways. No user has authority to bind Gigways or act on Gigways’ behalf.
10.9 Taxes, Insurance, Licenses, Permits, and Legal Compliance
Users are solely responsible for determining and complying with all laws and obligations that apply to their gig activities, including taxes, income reporting, licenses, permits, business registrations, insurance, workplace safety rules, labor laws, consumer protection laws, anti-discrimination laws, and any local, state, federal, or international requirements. Gigways does not provide tax, legal, insurance, employment, or professional advice.
10.10 Limitation of Liability for Gig Board Activity
To the fullest extent permitted by law, Gigways LLC and its affiliates, owners, officers, directors, employees, contractors, representatives, licensors, and service providers shall not be liable for any claims, losses, liabilities, damages, expenses, costs, or attorneys’ fees arising out of or related to the Gig Board, including but not limited to:
- unpaid work, missed payments, underpayments, refunds, chargebacks, or payment disputes;
- incomplete, late, defective, poor-quality, or unsatisfactory work;
- false, misleading, fraudulent, illegal, unsafe, or unavailable listings;
- user misconduct, harassment, discrimination, threats, assault, theft, scams, or fraud;
- personal injury, death, emotional distress, property damage, lost property, business interruption, or lost profits;
- communications, meetings, agreements, or transactions between users; or
- any indirect, incidental, special, consequential, exemplary, or punitive damages.
10.11 Indemnification for Gig Board Claims
You agree to indemnify, defend, and hold harmless Gigways LLC and its affiliates, owners, officers, directors, employees, contractors, representatives, licensors, and service providers from and against any and all claims, demands, actions, damages, losses, liabilities, settlements, judgments, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use or misuse of the Gig Board;
- any gig you post, accept, perform, cancel, fail to complete, or fail to pay for;
- your communications, meetings, transactions, agreements, or disputes with other users;
- your User Content, listings, messages, representations, or promises;
- your violation of these Terms, applicable law, or another person’s rights; or
- any allegation that Gigways is responsible for payment, employment, work quality, safety, supervision, or user conduct.
10.12 Reporting, Safety, and Enforcement
Users may report suspicious, unsafe, fraudulent, abusive, or policy-violating activity where reporting tools are available or by contacting Gigways support. Gigways may take enforcement action in its sole discretion, including removing content, restricting features, suspending accounts, terminating accounts, preserving records, or cooperating with law enforcement when legally required or when we believe there is risk to users, Gigways, or the public.
10.13 Survival and Maximum Protection
This Gig Board section is intended to provide Gigways the maximum protection permitted by law and shall apply to all Gig Board use, postings, communications, agreements, payments, disputes, and related conduct. If any part of this section is found unenforceable, the remaining provisions will remain in full force and effect.
11. Driver Density Map; Aggregation; Opt-In
If offered, the Driver Density Map displays aggregated, anonymized information derived from users who opt in. We do not display individual users’ precise locations. Participation is voluntary, and you may disable sharing at any time through settings and device permissions.
12. Drivers Benefits; Third-Party Links; Affiliate Disclosures
We may offer optional “Drivers Benefits” such as partner offers, discounts, and affiliate links. Third-party sites and services are not controlled by Gigways, and your interactions with them are governed by their own terms and privacy policies.

- Affiliate relationships: Where applicable, Gigways may receive a commission from affiliate links at no extra cost to you.
- No endorsement: Unless expressly stated, we do not guarantee third-party offerings, pricing, or availability.
13. Car Ads / Vehicle Advertising (If Offered)
Gigways may offer optional Car Ads / vehicle advertising programs that connect drivers who display advertisements on vehicles with advertisers running campaigns. Participation is voluntary for both drivers and advertisers. Additional eligibility requirements, verification steps, and program rules may apply and may be presented separately within the Services.
Drivers acknowledge that vehicles displaying advertisements may be visible in public and may be photographed or recorded by members of the public.
14. Subscriptions; Apple In-App Purchases; Billing; Refunds
Gigways may offer premium features through Apple In-App Purchases (IAP). Apple controls payment processing, billing, renewals, cancellations, and refund decisions. Gigways does not store your payment card details.

15. Intellectual Property; Trademarks
The Services, including all software, designs, text, graphics, logos, trademarks, and other content (excluding User Content) are owned by Gigways or its licensors and are protected by intellectual property laws. You may not use our trademarks without prior written permission.
16. Prohibited Conduct
You agree not to, and not to assist others to:
- Use the Services for unlawful, harmful, abusive, deceptive, or fraudulent purposes.
- Attempt to interfere with, disrupt, compromise, or circumvent security features or access controls.
- Reverse engineer, decompile, or attempt to extract the source code except where permitted by law.
- Scrape or harvest information without authorization.
- Post spam, impersonate others, or publish private information without permission.
17. Disclaimers; “As Is” Services
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Gigways disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.
18. Limitation of Liability
To the fullest extent permitted by law, Gigways shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your access to, use of, or inability to use the Services.
In no event shall Gigways’ total liability for any claim exceed the amount you paid to Gigways (if any) for the Services in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater, unless prohibited by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Gigways LLC and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.
20. Termination; Suspension; Enforcement
We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe (in our reasonable discretion) that you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or harmed other users or the platform.
You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification.
21. Changes to Services and Terms
We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms to reflect changes in our Services, legal requirements, or business practices. We will update the “Last Revised” date and provide notice of material changes where required by law. Your continued use of the Services after an update constitutes acceptance of the updated Terms, where permitted.
22. Governing Law; Jurisdiction; Venue
These Terms shall be governed by and construed in accordance with the laws of the State where Gigways LLC is organized and/or principally operates, without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms shall be resolved exclusively in the state or federal courts located in that jurisdiction, unless otherwise required by applicable law.
23. Miscellaneous; Severability; Assignment
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.
