1. Introduction

Welcome to Gigways LLC (“Gigways,” “we,” “our,” or “us”). Your privacy and the security of your personal information are of paramount importance to us. This Privacy Policy has been carefully crafted to provide you with a comprehensive understanding of how we collect, utilize, safeguard, and store the personal and usage data you provide when you access or interact with our mobile application (“the App”) and any related services.

Gigways is designed specifically to empower independent contractors and professionals operating within the gig economy—this includes rideshare drivers, delivery couriers, truck operators, and a wide range of other service providers. Our mission is to equip you with reliable and efficient tools that allow you to manage your schedules, meticulously track your earnings and expenses, and engage with a community that fosters connection and mutual support. In addition, we provide advanced safety and wellness features, including driving activity monitoring and the optional Focus Feature, which promotes well-being through collective rest coordination.

In the event of any conflict between this Privacy Policy and the Terms of Service, the Terms of Service shall govern. This Privacy Policy applies solely to data collection, use, and protection practices.

This Privacy Policy is provided for informational purposes only and does not constitute legal advice. Users are encouraged to review this policy carefully and consult legal counsel if they have questions about their rights or obligations.

Our Privacy Policy complies with all applicable international, federal, and state data protection laws, including but not limited to the General Data Protection Regulation (“GDPR”) applicable within the European Union, the California Consumer Privacy Act (“CCPA”), and the specific privacy mandates of the Apple App Store and Google Play Store. By downloading, installing, or otherwise using the Gigways application, you expressly consent to the data collection and usage practices described in this policy. We strongly encourage you to read this document thoroughly to understand how your information is handled and protected by our systems.


2. Information We Collect

In our commitment to data minimization and privacy, we collect only the information that is necessary to provide, maintain, and improve our services. The categories of data we gather include, but are not limited to, the following:

  • Personal Information: This category encompasses information that personally identifies you, such as your full name, email address, telephone number, and your state of residence. Additionally, we may collect any further profile information that you voluntarily provide in order to personalize your experience and facilitate app functionalities.
  • Activity and Usage Data: We collect detailed information about your work-related activities and app interactions. This includes, but is not limited to, data on your work schedules, hours logged, earnings and expenses tracked, and patterns of app usage. This information is instrumental in delivering seamless services and tailoring features to meet your needs.
  • Location and Motion Data (Optional and Consent-Based): With your explicit and informed consent, we may collect GPS location data and motion-related data to support various advanced features such as rest and break reminders, route optimization, and wellness initiatives tied to the Focus Feature. All such data collection is strictly opt-in, allowing you full control over whether or not to enable these capabilities.
  • Device and Technical Data: To maintain app security and ensure optimal performance, we collect technical details regarding your device, including device model, operating system version, IP address, and application logs. This data assists us in identifying and resolving technical issues, as well as optimizing the app for diverse device configurations.
  • Crash and Diagnostic Data: Limited technical logs used solely for troubleshooting, security monitoring, and performance optimization.
  • Car Ads / Vehicle Advertising Data (Optional): If you choose to participate in any Car Ads / vehicle advertising program offered that involves drivers displaying advertisements on vehicles and advertisers running campaigns, we may collect additional information depending on your role:
    • Drivers: vehicle details (such as make, model, year, color, and license plate number), verification media (photos or videos of the vehicle and ad placement), campaign participation status, and payout-related details. With your explicit consent, we may collect location and/or mileage data during active campaign participation for verification and reporting.
    • Advertisers: business and contact information, billing details, ad creative materials, targeting preferences, and campaign reporting/performance information.

3. Children’s Privacy

Protecting the privacy of minors is a responsibility we take seriously. The Gigways app and services are not designed for use by children under the age of 13 or the minimum age required by local laws. We do not knowingly solicit or collect personal information from children. If we become aware that we have inadvertently collected personal data from a minor, we will take immediate steps to delete such information in accordance with legal obligations.


4. User Consent and Control

We obtain your explicit and informed consent through clear in-app prompts, settings toggles, and permission requests before collecting any sensitive data such as location and motion information. You can review, modify, or withdraw your consent at any time through the app’s settings or your device’s privacy controls without affecting the lawfulness of prior processing. Our commitment is to provide you with easy-to-understand controls to manage your privacy preferences.

Withdrawing consent may limit or disable certain features but will not result in penalties or account termination.

If you participate in Car Ads / vehicle advertising features, any collection of verification media (such as photos) and any optional location, motion, or mileage tracking used for campaign verification and reporting will be subject to your explicit consent and can be managed through the app’s settings or your device permissions. Withdrawing consent may limit participation in Car Ads campaigns but will not otherwise restrict your access to non-Car Ads features.


5. How We Use Your Information

Your trust is essential, and we commit to using your information solely for legitimate and transparent purposes that directly benefit your user experience. Specifically, we employ your data to:

  • Facilitate and optimize the core functionalities of the Gigways app, including scheduling management, mileage tracking, logging expenses, and summarizing earnings, thereby empowering you to efficiently organize and monitor your gig economy work.
  • Support optional wellness and safety tools, including timely rest reminders and driving detection capabilities, activated exclusively with your consent. These features are designed to promote safer, healthier driving habits and overall well-being.
  • Create, maintain, and provide accurate work-related documentation such as detailed time logs and mileage reports, which can be utilized for personal record-keeping and tax preparation purposes.
  • Analyze anonymized, aggregated usage data to continually enhance the app’s functionality, interface design, and performance, ensuring that Gigways evolves in response to real user needs and behaviors.
  • Operate the optional Focus Feature, enabling users to voluntarily schedule rest days and wellness breaks. Data generated from participation supports calculation of driver density forecasts, providing valuable insights into driver activity and concentration by geographic location. Participation in this feature is strictly voluntary, and individual data is never shared with third parties.
  • If you participate in Car Ads / vehicle advertising:
    • For Drivers: to enroll and manage campaign participation; verify ad placement, display duration, and compliance; calculate campaign metrics (such as general geographic reach); provide support; prevent fraud; and process driver payments or rewards.
    • For Advertisers: to create and run campaigns; review campaign reporting; manage billing; measure and improve campaign performance; ensure compliance; and provide customer support.
  • We do not use your personal data for advertising, marketing, or promotional purposes, nor do we sell or distribute your information to third-party marketers or advertisers.

6. Automated Decision-Making and Profiling

Gigways does not use any form of automated decision-making or profiling that would have a legal or significant effect on you. All decisions regarding your account and services are reviewed or implemented with appropriate human oversight.

Car Ads / vehicle advertising campaign matching, if offered, may involve software-assisted recommendations based on non-sensitive factors (such as general geography, vehicle eligibility criteria, and campaign availability). Participation is optional and does not produce legal or similarly significant effects on users.


7. Data Sharing and Security

The protection of your personal information is a cornerstone of our privacy commitment. Gigways does not engage in the sale, rental, or leasing of your personal data to third parties. However, to improve service delivery and app performance, we may share aggregated and anonymized data sets with carefully vetted service providers and trusted partners. This shared data is stripped of all personally identifiable information and is used solely for analytical or operational purposes.

We have implemented robust, industry-leading security measures—including advanced encryption protocols for data both in transit and at rest—to ensure your data is safeguarded against unauthorized access, disclosure, alteration, or destruction. Access to your personal information is strictly limited to Gigways employees, contractors, and service providers who require it to perform their job functions and who are bound by confidentiality obligations.

Specifically, we employ SSL/TLS encryption for data transmission, encrypt sensitive data at rest, conduct regular security audits, and apply best practices to maintain data integrity and confidentiality.

Gigways is not responsible for the privacy practices of third-party services linked from or integrated with the app. Users should review third-party privacy policies independently.

If you participate in Car Ads / vehicle advertising, we may share limited information as needed to operate campaigns, such as:

  • Reporting to Advertisers: We may provide advertisers with campaign reports that may include aggregated or anonymized performance data (for example, generalized geographic reach, estimated impressions, and campaign duration). We do not share drivers’ personal contact details with advertisers unless explicitly required for campaign operations and permitted by the driver.
  • Verification and Compliance: Verification media (such as photos of ad placement) may be reviewed by Gigways and/or service providers acting on our behalf solely to validate compliance and reporting.
  • Service Providers: Payment processors, analytics providers, hosting services, and customer support tools may process data as necessary to operate the Car Ads program under contractual confidentiality and data protection obligations.

8. Third-Party Service Providers

To support our services, we engage trusted third-party providers including cloud hosting services, email communication platforms, and payment processors. These providers are contractually obligated to comply with applicable data protection laws and only process your data under our instructions. We carefully select these partners to maintain the highest standards of privacy and security.

Third-party providers act solely as data processors and may not use personal data for their own purposes.

For Car Ads / vehicle advertising, additional providers (such as verification, campaign measurement, or payouts partners) may be used. Any such providers are required to process data only under Gigways’ instructions and consistent with this Privacy Policy.


9. Location and Tracking Compliance

Gigways fully complies with the privacy guidelines set forth by Apple and Google regarding location and motion tracking. All such features are disabled by default and are activated solely upon your explicit, informed consent. These features facilitate the provision of safety alerts, gentle rest reminders, accurate work tracking, and participation in the Focus Feature’s wellness initiatives. You maintain full control over enabling or disabling these features at any time through the app’s settings or your device’s privacy controls.

If you participate in Car Ads / vehicle advertising, any location, motion, or mileage tracking used for campaign verification and reporting follows the same consent-based approach described above and remains disabled by default unless you explicitly enable it.


10. Driver Density Map Privacy

The Driver Density Map feature provides anonymized and aggregated location data exclusively from users who opt to share this information. The sole purpose of this feature is to present real-time insights into driver concentrations, helping users make informed decisions regarding work locations and schedules.

  • We do not disclose or share any individual’s precise location or personally identifiable information.
  • Participation is completely voluntary, and users may revoke location sharing at any time.
  • We maintain stringent security practices to ensure that all shared data is fully protected.

11. Cookies and Tracking Technologies

Our website and application use cookies and similar technologies to improve your browsing experience, remember preferences, and facilitate navigation. These include:

  • Necessary Cookies: Essential for app and website functionality.
  • Performance Cookies: Help us analyze and improve site performance.
  • Functional Cookies: Enable enhanced features and personalization.

You can manage, restrict, or disable cookies through your browser or device settings. Please note that disabling cookies may affect some features of our app or website.

Gigways currently limits analytics usage. If third-party analytics or crash reporting tools are introduced in the future, this policy will be updated prior to activation.


12. Notifications

We may send notifications to keep you informed about important updates related to your work schedule, earnings, breaks, and safety reminders, including driving activity alerts—only after obtaining your explicit consent. You can customize or disable these notifications at any time through your device’s notification settings to suit your preferences.

If you participate in Car Ads / vehicle advertising, we may send notifications related to campaign status, verification requests (such as reminders to upload ad placement photos), compliance, and payout updates. You may disable these notifications through your device settings, but doing so may limit timely campaign participation or verification.


13. Data Retention

Gigways retains personal and usage data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including compliance with legal obligations, resolving disputes, and enforcing agreements. Approximate retention periods include:

  • Personal Information: Retained for the duration of your account activity plus 1 year after account deletion.
  • Activity and Usage Data: Retained for up to 2 years for analytical and service improvement purposes.
  • Location and Motion Data: Retained only during active app usage and for brief periods thereafter, unless otherwise consented.

Upon your request to delete your account or data, we will promptly delete all personally identifiable information except where retention is required by law for purposes such as tax reporting or legal compliance.

Data may be retained longer where required to comply with legal obligations, enforce agreements, respond to lawful requests, or resolve disputes (“legal hold”).

For Car Ads / vehicle advertising, we may retain limited campaign participation records, verification logs (including submitted media), and payout-related records for a reasonable period to operate the program, prevent fraud, complete accounting, and comply with legal obligations.


14. Impact of Opting Out of Tracking

Disabling location tracking or opting out of certain data collection features may reduce or limit your access to certain app functionalities such as rest reminders, the Driver Density Map, and other wellness tools. We encourage users to carefully consider these implications before opting out to maximize their experience with Gigways.

If you participate in Car Ads / vehicle advertising, opting out of verification requirements (including optional location, motion, or mileage tracking where used) may prevent enrollment in campaigns, pause campaign eligibility, or limit payout verification, depending on the program requirements.


15. Car Ads / Vehicle Advertising Privacy (Drivers and Advertisers)

Gigways may offer optional Car Ads / vehicle advertising features that connect drivers who choose to display advertisements on their vehicles with advertisers who run campaigns. Participation is voluntary for both drivers and advertisers. This section describes how data may be handled when you participate in these features.

Drivers – Information Collected and Used

  • Vehicle and Eligibility Data: Vehicle details may be collected to confirm campaign eligibility and ensure proper installation and compliance.
  • Verification Media: Photos or videos may be collected to verify ad placement, continued display, and campaign compliance.
  • Location / Mileage (Consent-Based): With your explicit consent, location and/or mileage data may be collected during active campaigns to verify participation and create performance reports.
  • Payout Information: Limited information may be used to calculate and process campaign payouts or rewards.

Advertisers – Information Collected and Used

  • Account and Billing Data: Business/contact and billing details may be collected to set up and manage campaigns.
  • Campaign Content: Ad creatives, campaign parameters, and preferences are used to deliver and manage campaigns.
  • Campaign Reporting: Campaign reporting may include aggregated or anonymized metrics (such as generalized geographic reach, estimated impressions, and campaign duration).

How Information Is Shared

  • With Advertisers: We generally share campaign performance data in aggregated or anonymized form. We do not share drivers’ personal contact information with advertisers unless required for a specific operational need and permitted by the driver.
  • With Service Providers: We may use service providers for hosting, measurement, verification, customer support, and payments. They may access data only to perform services for Gigways and are bound by confidentiality and data protection obligations.
  • Legal and Safety: We may disclose information if required by law or to protect the rights, property, or safety of Gigways, users, advertisers, or the public.

Public Visibility

Drivers acknowledge that vehicles displaying advertisements may be visible in public and may be photographed or recorded by members of the public. Gigways may also use verification media for compliance, reporting, and limited marketing purposes related to the Car Ads program.

Controls

Drivers can manage participation and related permissions (including location permissions, where applicable) through app settings and device controls. Advertisers may update campaign content and preferences through their account tools, where available.


16. Your Rights and Choices

Depending on your jurisdiction, you may have specific legal rights with respect to your personal data, including the right to access, rectify, erase, restrict, or object to processing, as well as the right to data portability. You also have the right to withdraw consent at any time without affecting the lawfulness of prior processing.

You can exercise these rights by:

  • Accessing and updating your information directly within the Gigways app.
  • Requesting a copy of your data in a portable format via Support@gigways.com.
  • Requesting deletion or deactivation of your account at any time.

We strive to respond to all privacy-related inquiries promptly, typically within 30 days.


17. Subscriptions and Apple Payments

Gigways offers optional premium features through Apple In-App Purchases (IAP). All payments, billing, and subscription management are handled directly by Apple. Gigways does not store or have access to your credit card details, Apple ID, or billing information.

Information We Receive

When you subscribe, we only receive limited, non-sensitive data from Apple, such as your subscription status (active, expired, or canceled) and receipt validation information used to confirm your purchase. This information is used only to enable and maintain your premium access.

How to Manage Your Subscription

You may cancel or change your subscription at any time through your Apple ID settings:

  • Settings → Your Name → Subscriptions

Subscriptions renew automatically unless canceled at least 24 hours before renewal.

Refunds

Refunds for subscriptions must be requested directly from Apple. Gigways cannot issue refunds.

Free Trials

Any free trial is managed by Apple and may automatically convert to a paid subscription unless canceled before the trial ends.

Data Security

All subscription validation data received from Apple is encrypted and securely stored. Only authorized Gigways personnel can access it for support and verification purposes.


18. Private Trips Privacy, Safety, and Liability Notice

Private Trips is an optional feature designed solely to help users coordinate friends rides, food pickup, and parcel drop with individuals they personally know and trust. The feature functions only between users who have mutually added each other as friends or trusted contacts within the Gigways platform. Private Trips is not available to the general public, does not connect users with strangers, and is not intended for use with unknown or unverified individuals.

Private Trips is a coordination feature only and does not involve Gigways in execution, fulfillment, or supervision of any activity.

Private and Mutually Added Contacts

Private Trips may be used exclusively between users who have mutually confirmed each other as friends or trusted contacts. Both users must establish this connection before any Private Trip request can be sent or accepted. Gigways does not match, assign, introduce, or connect users and is not involved in initiating, arranging, or directing any ride, food pickup, or parcel drop activity.

Not a Transportation, Delivery, or Logistics Provider

Gigways is not a Transportation Network Company (TNC), ride-hailing service, taxi service, courier service, food delivery service, dispatcher, commercial transportation provider, or logistics platform. Gigways does not provide transportation, food delivery, or parcel delivery, does not operate vehicles, and does not control, supervise, or manage any activity that takes place between users who choose to coordinate Private Trips.

Optional Contributions Outside of Gigways

Any contribution, reimbursement, or payment offered or exchanged between users is entirely optional and takes place outside of Gigways. Gigways does not support, endorse, manage, process, track, or participate in any financial, material, or personal arrangement between users under any circumstances.

Information Shared for Private Trips

Only minimal information is used to facilitate coordination between mutually approved users, such as names and general request details related to a ride, food pickup, or parcel drop. Gigways does not share precise GPS location data or personal information with anyone outside the approved friend connection unless required by law or explicitly authorized by the user.

Consent for Phone Number Sharing

For the purpose of coordinating a Private Trip, participating users may choose to share their phone numbers with one another. By requesting or accepting a Private Trip, users explicitly agree that:

  • Their phone number may be shared with the mutually approved contact for coordination purposes.
  • They may receive calls or messages only related to the privately arranged ride, food pickup, or parcel drop.
  • Gigways does not access, monitor, record, or store the content of calls or messages.

Friends Rides Disclaimer (Accidents, Injury, Death, Vehicle Damage)

Friends rides arranged through Private Trips are private arrangements between users. Gigways does not provide any transportation service, does not screen drivers or passengers, and does not supervise any ride.

  • No Insurance: Gigways does not provide insurance coverage of any kind for rides coordinated through Private Trips.
  • No Responsibility: Gigways is not responsible or liable for any accident, injury, death, assault, theft, dispute, or any other incident that may occur before, during, or after a ride.
  • No Vehicle Coverage: Gigways is not responsible for any damage to vehicles, property, or personal items, including any repairs, towing, loss of use, or related costs.
  • User Risk: Users assume all risks and are solely responsible for their own safety decisions and compliance with applicable laws (including seat belt laws, licensing, insurance requirements, and traffic laws).

Parcel Drop Disclaimer and User Responsibility

Parcel drop requests are private arrangements between users who personally know and trust each other. Gigways does not inspect, verify, track, store, or take possession of any parcel.

  • Gigways is not responsible or liable for any lost, stolen, damaged, delayed, misdelivered, or tampered-with parcels.
  • Gigways makes no representations regarding parcel contents, value, legality, safety, or condition.
  • Users are solely responsible for the contents, packaging, labeling, legality, and safety of any parcel.
  • Users are advised not to send cash, valuables, fragile items, hazardous materials, illegal items, or irreplaceable goods.
  • Any dispute related to parcel drop activities is strictly between the participating users.

Food Pickup Disclaimer and User Responsibility

Food pickup requests are private, non-commercial arrangements between users who personally know and trust each other. Food pickup involves a mobile or direct order placed by the user with a third-party store or restaurant, which is then picked up and brought by a mutually approved trusted contact.

Gigways does not place, modify, manage, or pay for food orders, does not prepare or inspect food, and does not interact with restaurants or stores.

  • Gigways is not responsible or liable for food quality, preparation, order accuracy, missing items, temperature, freshness, contamination, spoilage, allergies, dietary restrictions, or foodborne illness.
  • All food-related risks are assumed entirely by the users.
  • The user placing the order is solely responsible for ensuring accuracy, suitability, and compliance with dietary or allergy requirements.
  • Gigways does not guarantee pickup timing, delivery timing, food condition, or availability of any food item.

User Tools: Unfriend, Block, and Report

Users may have options within the app to unfriend, block, and report other users. If you feel unsafe, are harassed, or suspect fraud or scams, we encourage you to stop contact immediately, use the in-app tools where available, and contact local authorities when appropriate.

Account Suspension and Termination (Fraud, Scams, Illegal Activity, Excessive Reports)

Gigways reserves the right, in its sole discretion, to investigate suspected violations and take appropriate enforcement action, including warnings, restricting features, suspending, or permanently terminating accounts. This may apply to conduct including (but not limited to) illegal activity, fraud, scams, harassment, abuse, misuse of Private Trips, or repeated user reports/blocks indicating risky behavior. We may also cooperate with law enforcement when required by law.

User Responsibility and Assumption of Risk

All Private Trips are voluntary, private arrangements between individuals who personally know and trust each other. Users acknowledge and accept full responsibility for their interactions and assume all risks associated with coordinating or participating in a Private Trip, including rides, food pickup, and parcel drop activities. Gigways does not verify the identity, behavior, driving ability, vehicle condition, safety practices, parcel contents, or food handling practices of any user.

No Duty of Oversight or Guarantees

Gigways has no duty to supervise, monitor, evaluate, or control any user activity related to Private Trips. The Private Trips feature is provided “as is” without any warranties or guarantees regarding safety, suitability, legality, reliability, or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Gigways LLC shall not be responsible or liable for any injuries, accidents, damages, losses, disputes, misconduct, ride-related incidents, vehicle damage, food-related issues, allergic reactions, foodborne illness, parcel loss, theft, damage, delay, or misdelivery that occur before, during, or after a privately coordinated Private Trip. All liability rests solely with the participating users.

Indemnification

Users agree to indemnify, defend, and hold harmless Gigways LLC, its affiliates, employees, and representatives from any claims, damages, expenses, or liabilities arising out of their participation in Private Trips, including rides, food pickup, and parcel drop activities.

No Agency or Employment Relationship

Use of Private Trips does not create any employment, agency, contractor, partnership, joint venture, or representative relationship between users and Gigways. Gigways does not direct or control user actions or decisions.

Opt-Out and User Control

Users may disable the Private Trips feature at any time through their account settings. Once disabled, all associated communication, visibility, and data use related to Private Trips will immediately stop.


19. User Acceptance and Binding Agreement

By clicking “Accept,” “I Agree,” “Agree,” “Continue,” “Get Started,” “Sign Up,” or “Log In,” or by otherwise accessing, registering for, previewing, or using the Gigways platform (including any features available before login), the user confirms that they have read, understood, and agree to be legally bound by: (a) this Privacy Policy, (b) the Terms of Service, and (c) all related notices, disclaimers, and policies, including those applicable to Private Trips, food pickup, and parcel drop.

This acceptance forms a legally binding agreement between the user and Gigways LLC, effective immediately at the moment the user clicks an acceptance button or otherwise proceeds to use the platform, even if the user does not complete registration, does not create an account, or does not successfully log in.

If the user does not agree to be bound, the user must not click Accept (or any equivalent button) and must immediately discontinue access to and use of the Gigways platform and its features.

Material changes to this Privacy Policy will be communicated through the app or website, and continued use of the platform after such notice constitutes acceptance of the updated policy.

Continued access to or use of the Gigways platform after acceptance constitutes ongoing consent to this Privacy Policy and agreement to any updates or modifications made in accordance with the Terms of Service.
